NOTICE OF ASSENT VOTING ELECTORAL AREA “F” MOSQUITO CONTROL

On Saturday, March, 2, 2024 an assent voting opportunity will be held for Electoral Area “F” of the Regional District of North Okanagan on the following question:

“Are you in favour of the Regional District of North Okanagan adopting “Electoral Area “F” Mosquito Control Service Establishment Bylaw No. 2973, 2023”, which would establish a service within the boundary of Electoral Area “F” to control mosquito larval habitats within specific areas of the Shuswap River floodplain to prevent the spread of mosquitos; which if approved will result in an annual requisition to not exceed the greater of $289,000 or $0.17 per $1,000 of net taxable value of land and improvements.”

ELECTOR REGISTRATION

There is no need to pre-register to vote as the registration of qualified electors will take place at the time of voting. You will be required to make a declaration that you meet the following requirements:

RESIDENT ELECTORS:

To register as a resident elector you must:

  • be 18 years of age or older on general voting day;
  • be a Canadian citizen;
  • be a resident of British Columbia for at least 6 months immediately before the day of registration (at time of voting);
  • be a resident of Electoral Area “F” on the day of registration (at time of voting); and
  • not be disqualified under the Local Government Act or any other enactment from voting in an election or assent voting and not otherwise disqualified by law.

Resident electors will also be required to produce 2 pieces of identification (at least one with a signature). Picture identification is not necessary. The identification must prove both residency and identity.

NON-RESIDENT PROPERTY ELECTORS:

To register as a non-resident property elector, you must:

  • be 18 years of age or older on general voting day;
  • be a Canadian citizen;
  • be a resident of British Columbia for at least 6 months immediately before the day of registration (at time of voting);
  • be a registered owner of real property in Electoral Area “F” for at least 30 days immediately before the day of registration (at time of voting);
  • not be entitled to register as a resident elector; and
  • not be disqualified under the Local Government Act or any other enactment from voting in an election or assent voting and not otherwise disqualified by law.

In addition, for non-resident property electors:

  • The only persons who are registered owners of the property, either as joint tenants or tenants in common, are individuals who are not holding the property in trust for a corporation or another trust.
  • If more than one person is registered owner of the property, only one of those individuals may, with the written consent of the majority of the owners, register as a non-resident property elector.

Non-resident property electors must produce 2 pieces of identification (at least one with a signature) to prove identity, prove that they are entitled to register in relation to the property, and, if applicable, written consent from the majority of the property owners. Please note that individuals will not be eligible to vote on behalf of a Corporation. There is no Corporate Vote.


ELECTORAL AREA “F” MOSQUITO CONTROL SERVICE ESTABLISHMENT BYLAW

REGIONAL DISTRICT OF NORTH OKANAGAN

BYLAW No. 2973

A bylaw to establish a mosquito control service within Electoral Area “F”

WHEREAS the Local Government Act (Act) provides that the Board of the Regional District of North Okanagan may, by bylaw, establish and operate any service that the Board considers necessary or desirable for all or part of the regional district;

AND WHEREAS the Board wishes to establish a service for the purpose of providing a mosquito control program within Electoral Area “F”;

AND WHEREAS consent on behalf of the participating areas will be by Alternative Approval Process in accordance with subsections 342(2)(b), 342(4) and 345(1)(a) of the Act;

NOW THEREFORE the Board of the Regional District of North Okanagan in an open meeting assembled, hereby enacts as follows:

CITATION

1. This Bylaw may be cited as “Electoral Area “F” Mosquito Control Service Establishment Bylaw No. 2973, 2023”.

ESTABLISHMENT AND DESCRIPTION OF SERVICE

2. The Regional District is authorized to establish a service for the purpose of providing a mosquito control program within Electoral Area “F”.

SERVICE AREA BOUNDARIES

3. The boundary of the service area is the boundary of Electoral Area “F”.

PARTICIPANTS

4. The participant of this service is Electoral Area “F”.

COST RECOVERY

5. The annual cost of providing the service outlined in this Bylaw shall be recovered by one or more of the following:

a. requisition of money under section 387 [Requisition of funds for electoral areas] of the Act to be collected by a property value tax to be levied on land and improvements for regional hospital district purposes and collected under section 388 [Collection in electoral areas] of the Act.

b. revenue received by way of agreement, enterprise, gift, grant or otherwise.

6. The maximum amount that may be requisitioned annually for the service shall not exceed the greater of $289,000 or $0.17 per $1,000 of net taxable value of land and improvements included in the service area.

COST APPORTIONMENT

7. The annual cost of this service shall be apportioned amongst the participants on the basis of the value of land and improvements for regional hospital district purposes in those areas.
